User Agreement

• This Agreement is an agreement between you and FineJordan.com relating to your use of  FineJordan.com service and any related products and services (collectively “Service”). This Agreement affects your rights and you should read it carefully.
 
• IF YOU DO NOT ACCEPT THESE TERMS, PLEASE DO NOT GO ON THE REGISTRATION PROCESS. Use of the Service by you is subject to FineJordan.com's approval of your registration application.
 
• FineJordan.com may amend any of these terms at any time by posting the amended terms to our website, and your continued use of the Service after the date of such posting will constitute your acceptance of the amended terms. This Agreement was last amended on 8 September 2002.
 
1.YOUR RESPONSIBILITIES  
 
1.1 Eligibility 
In order to use the Service, you must register for the Service and upon FineJordan.com's approval, you will be assigned a Member Account ("MA"). You must be at least 18 years of age to register for an account. If you are under the age of 18, you must first obtain the consent of your parent or guardian and your continued use of the Service is your representation that you have obtained such consent to use the Service. 
 
1.2 Privacy
You agree that you have had an opportunity to review, download or print FineJordan.com's privacy policy. Any personal information provided by you shall be used only for processing payments and accessing your "MA". FineJordan.com shall not make use of any personal information for any other purpose, and shall not transfer it to any third party. You hereby agree to the use of any personal information submitted to FineJordan.com as stated above. 
 
1.3 Registration Information
You agree to provide true, accurate and complete registration information and to maintain and promptly update your information as applicable. You shall not impersonate any person or use a name other than your own. If any information you provide is untrue, inaccurate, outdated or incomplete, FineJordan.com has the right to terminate your use of the Service and FineJordan.com, its agents, suppliers, and subcontractors have the right to recover from you any cost or loss incurred or suffered as a result of such untrue, inaccurate, outdated or incomplete information. You authorise FineJordan.com to make such inquiries as it considers necessary to validate your registration.
 
1.4 ID and Password 
You shall be required to specify your preferred FineJordan.com's ID ("ID") and Password (“PWD”). The ID and PWD shall be used only by you to access, transact and protect your "MA". You must not divulge your ID and PWD to any person. It is important that you keep your ID and PW secret and exercise security to prevent unauthorised disclosure in order to protect your "MA". FineJordan.com 's shall not be held responsible for losses incurred by you as a result of the use of the ID and PWD by any person. 
 
1.5 Unauthorised Access
It is very important that you notify FineJordan.com.com immediately if you believe your ID or PWD has been compromised, or if any person has used or accessed your "MA".
 
1.6 Non-Banking Service
You acknowledge that:
(i)  the Service is not a banking service;
(ii) the Service is not subject to banking regulations.
 
1.7 Recipient Refusing Payment
You acknowledge that when you send a payment to a party, the recipient is not required to accept the payment and is free to return the payment or deny the payment through the Service and FineJordan.com shall not be liable for any damages resulting from the recipient's decision not to accept a payment.
 
1.8 Internet Provisions
You shall be responsible for obtaining and using the necessary web browser and/or other software and/or equipment necessary to obtain access and transact using the Service at your own risk and expense. If new or different versions of the web browser and/or other software and/or hardware and/or equipment necessary for the operation of the Service becomes available, FineJordan.com 's reserves the right not to support any prior version of the web browser or other software. If you fail to upgrade the relevant software and/or web browser or to use the enhanced version of software and/or web browser as required by the Service, FineJordan.com may reject your transactions, or process your transactions incorrectly, or you may not be able to obtain access to all features and/or services available, and FineJordan.com shall not be held liable as a result thereof.
 
2 RIGHTS and DISCLAIMERS of FineJordan.com
 
2.1 Trademark
The trademarks, logos, and service marks (collectively the "Trademarks") displayed on FineJordan.com 's or service providers' sites (collectively the "Sites") are the property of FineJordan.com Nothing herein and in the Sites should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Sites without the written permission of FineJordan.com. Your use of the Trademarks displayed on the Sites, or any other content on the Sites, except as provided in this Agreement, is strictly prohibited. FineJordan.com will enforce its intellectual property rights to the fullest extent of the law, including the institution of criminal prosecution.
 
2.2 Accuracy of Payment Information
FineJordan.com shall not be responsible for payments made to a wrong recipient or for payments made in incorrect amounts due to the input of incorrect or incomplete information by you.
 
2.3 Fees
FineJordan.com reserves the right to levy fees, and from time to time vary the fees, for the use of the Service. FineJordan.com shall inform you of such fees through its Communications.
 
2.4 Force Majeure
No failure or omission by FineJordan.com to carry out its obligations or observe any of the stipulations or conditions of this Agreement shall give rise to any claim against FineJordan.com or be deemed a breach of this Agreement if such failure or omission arises from a cause of force majeure, including acts of God, war or warlike hostilities, civil commotions, riots, blockades, embargoes, sabotage, strikes, lockouts, shortage of material or labour, delay in deliveries from sub-contractors or machine failure caused by force majeure or any other event outside the control of FineJordan.com
 
2.5 Warranties
The Service is provided on an "as is" basis without warranties of any kind, express or implied, including without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. Without limiting the generality of the preceding sentence, FineJordan.com does not warrant that the use of the Service will be uninterrupted or that the operation of the Service will be error-free or fully secured.
 
2.6 Termination and Suspension
FineJordan.com shall have the right to terminate or suspend this Agreement or the use of access to any Service or your "MA" without notice at any time without assigning a reason therefor.
 
3 OTHER
 
3.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of China.
